ATYPICAL GENERAL CONDITIONS

  1. Object of the online contract and its definition

    By "online" sales contract we mean the distance contract and that is the legal transaction having as its object movable goods and/or services stipulated between a supplier, NOBE SRL (manager of the ATIPICI website at the url: www.atipicishop.com) with headquarters in Via Giacosa 9 10036 Turin, Italy – VAT number 13069530015
    - and a consumer customer within a distance selling system organized by the supplier, who, for this contract, uses the remote communication technology known as the "internet." All contracts, therefore, will be concluded directly through the consumer customer's access to the corresponding website at http://www.atipicishop.com. Following the indicated procedures, the consumer will conclude the contract for the purchase of the goods. A final consumer is defined as a natural person who purchases goods and services for purposes not directly related to any professional activity they may carry out. The following are the conditions of sale, which will remain in effect until modified by the supplier. Any changes to the conditions of sale will be effective from the moment they are published on the website and will apply to sales made from that moment on.


  2. Sales prices and purchasing methods

    All prices for services displayed and indicated on the website, which constitute an offer to the public pursuant to Article 1336 of the Italian Civil Code, include VAT and all other taxes (unless otherwise indicated). Where shipping costs apply, this is clearly highlighted on the dedicated page on the website, which the customer must review before confirming the purchase. For deliveries abroad, any additional costs due to taxes or duties imposed by the legislation in force in the destination country will be borne by the customer. The purchase contract is concluded by accurately completing and confirming the purchase by signing the online order form. The customer may pay for the ordered goods using only the payment methods indicated online at the time of purchase and within 7 days of placing the online order.


  3. Buyer's obligations

    Once the online purchase process has been completed, the consumer undertakes to print and retain these general terms and conditions, which they will have already reviewed and accepted as a mandatory step in the purchase, as well as the specifications of the purchased product, in order to fully satisfy the conditions set forth in Articles 3 and 4 of Legislative Decree No. 185/1999. The buyer is strictly prohibited from entering false, invented, and/or fictitious information during the registration process required to initiate the execution of this contract and any related communications. Personal details and email address must be exclusively the buyer's own real personal information and not those of third parties or fictitious information. It is expressly forbidden to make duplicate registrations for the same person or to enter third party information. Suite Atipici reserves the right to take legal action against any violation or abuse, in the interest and protection of all consumers.


  4. Contractual Termination and Express Termination Clause

    NOBE SRL reserves the right to terminate the contract by simply notifying the customer with adequate and justified reasons. In this case, the customer will only be entitled to a refund of any sums already paid.


  5. Jurisdiction and competent court

    Any dispute relating to the application, execution, interpretation, and violation of purchase contracts entered into online through the www.atipicishop.com website is subject to Italian jurisdiction. These general conditions, unless expressly provided for herein, are governed by the combined provisions of Legislative Decree No. 50 of January 15, 1992, and Legislative Decree No. 185 of May 22, 1999. Any dispute between the parties relating to this contract shall be subject to the jurisdiction of the Court of the Customer's residence or the consumer's chosen domicile (Article 1469-bis, No. 19). For all other disputes, the Court of Turin shall have jurisdiction.
